Why should I hire a lawyer if I know
that I am guilty?
There are several reasons why you should hire an experienced lawyer.
Just because you are arrested does not mean you will be convicted. The
Police have protocol they must follow. If they do not, it is possible
some evidence could be suppressed. This could lead to dismissal.
Another reason you should hire a lawyer the State Attorney may charge
you with several crimes that arise out of one event. An experienced
lawyer will do their best to get charges reduced or dismissed.
You should hire a lawyer if you are charged with a crime to ensure that
you get the best possible result. While you may be guilty, there may
be reasons to mitigate your fines and/or jail time. You may be able
to enter a program that could keep your charge of your criminal record.
Aren't I entitled to a Public Defender?
You are not always entitled to a Public Defender. The Court will
make a determination based on your financial situation. If you do not
qualify, you will not get a Public Defender.
The Police Officer didn't read me
my rights. How does that affect my case?
Once you are arrested, the Police must read you your rights, if they
are going to question you about your case. If you were arrested and
were then questioned without hearing your rights, your statements may
be suppressed. This could be advantageous to your case.
I heard my case will be dismissed
if the witness doesn’t show. Is this true?
Not always. The State Attorney has the burden to prove beyond a reasonable
doubt that you are guilty. Eye witness statements are valuable in proving
a case, however it’s not the only way to prove a case against you.
If you have made statements against your interest, the State could use
this against you. Other circumstantial evidence can be used as well.
